Algorithm for Obtaining Exclusive Rights to the Intellectual Activity Results by Legal Entities and their Disposal in the Donetsk People's Republic

The formation of the institute to protect the intellectual property plays a significant role in the socio-economic development of the state, since innovation contributes to the national production improvement, which increases its competitiveness at the world level. In modern conditions, most of the intellectual activity results are created when an employee performs his duties, so it is very important to have a clear legal regulation of such relationships.
The conditions prevailing in the Donetsk People's Republic complicate the development of the innovative activity and the formation of the institution to protect its results. It should be noted that currently the legislation of the DPR contains only general rules regarding the activity in question. Such an approach to regulating relations in the field of innovation does not contribute to the proper regulation of relations that arise at all stages of the innovation process from the inception of an idea to its commercialization, which generally negatively affects the economic and social development of the state.
The authors of the article have developed proposals for the formation of an algorithm for obtaining exclusive rights to RIA by legal entities and their disposal in the Donetsk People's Republic.
The relations in the field of rights to the results of the intellectual activity and means of individualization are regulated by the Civil Code of the DPR (Book 4), which sets out the general provisions of the right to the results of intellectual activity, defines subjects and objects, property rights, and the duration of exclusive rights. Due to the lack of subordinate normative legal acts that ensure the implementation of administrative procedures for the state registration and the transfer of rights to the results of the intellectual activity, procedures related to the state registration, as well as forms of protection titles, rights to the results of the intellectual activity are not registered and, as a result, are not protected.
The algorithm for obtaining exclusive rights to the intellectual activity results by legal entities and their disposal in the Donetsk People's Republic, developed on the basis of the current legislation, is presented. The necessity of the development and adoption of subordinate normative legal acts regulating certain aspects of relations between the participants of the process considered in the algorithm is determined.
